IMPORTANT INFORMATION AND DISCLAIMER

Important Information

IEMC Group Pty Ltd (“IEMC”) provides administrative, referral, coordination and facilitation services in connection with education, migration, visa, insurance, training, Recognition of Prior Learning (RPL) and related service enquiries.

IEMC may act as a sub-agent, referral partner, intermediary or administrative facilitator for third-party business partners, including education providers, RPL service partners, Registered Training Organisations (RTOs), migration professionals, insurers, government authorities and other service providers.

Unless expressly stated otherwise in writing, IEMC does not directly deliver courses, conduct training, conduct formal RPL competency assessments, determine competency, issue qualifications, provide insurance products, make visa decisions or guarantee admission, enrolment, assessment, qualification, insurance, visa or service outcomes.

All final decisions and outcomes are determined independently by the relevant education provider, RPL Partner, RTO, insurer, government authority, migration professional or other responsible third party.

RPL Services

For RPL matters, IEMC provides administrative, referral, document coordination and facilitation services. IEMC works with an independent third-party RPL service partner (“RPL Partner”). The RPL Partner liaises with and/or arranges assessment through an appropriately registered RTO.

IEMC is not an RTO. IEMC does not conduct the formal RPL assessment, determine competency or issue AQF qualifications or Statements of Attainment. The relevant RTO independently determines the evidence and assessment requirements, assesses competency and decides whether a qualification or Statement of Attainment can be issued.

Any preliminary review, eligibility discussion, document check or indication that RPL may be available is not an assessment outcome and does not guarantee that a qualification will be issued.

RPL Provider and Regulatory Risk

RTOs and RPL service providers operate within a regulated vocational education and training environment. Registration, scope of registration, regulatory requirements and provider circumstances may change.

To the fullest extent permitted by law, IEMC is not responsible for subsequent cancellation, invalidation, withdrawal or regulatory action affecting an already-issued qualification where that action arises from the conduct, registration status or compliance of the RPL Partner or RTO outside IEMC’s reasonable control.

This does not mean that an RTO’s registration change automatically cancels every qualification it has issued. Any regulatory effect on a qualification depends on the action taken by the relevant regulator and the circumstances of the qualification.

RPL Full-Refund Commitment Before Qualification Issue

Where the client has paid the agreed RPL fees, complied with all reasonable evidence and assessment requirements, and the RPL Partner confirms that the arranged RTO cannot issue the agreed qualification for reasons attributable to the RPL Partner or RTO, IEMC will provide a full refund of the affected RPL service and qualification fees paid to IEMC for that application, subject to applicable law and the applicable service agreement.

This commitment does not apply where non-issuance results from insufficient evidence, a not-competent assessment, false or unverifiable information, failure to complete assessment requirements, client withdrawal or change of mind, failure to cooperate, or other circumstances attributable to the client.

Education Applications

Where IEMC assists with education applications, admission, enrolment, course availability, provider refunds and COE decisions are made by the relevant education provider. IEMC does not guarantee admission, enrolment or COE issuance.

Once an education application has been submitted, IEMC service fees for that application are non-refundable except where required by law or expressly agreed otherwise. Where an Offer Letter has been issued and the client later changes their mind, withdraws or does not proceed with payment and/or COE issuance, an Education Application Fee of AUD $550 (inclusive of GST) applies under the applicable Costs Agreement/Service Agreement and Refund and Cancellation Policy.

No Guarantee

Any preliminary review, consultation, eligibility discussion, document check, quotation, estimate or referral is for general administrative and facilitation purposes only and does not guarantee approval, enrolment, qualification issuance, insurance approval, visa grant, refund or any other outcome.

Third-Party Providers

Clients may be required to sign separate agreements or documents with third-party providers. Clients should read all third-party documents carefully before signing or making payment.

To the fullest extent permitted by law, IEMC is not responsible for independent third-party decisions, delays, refusals, cancellations, policy changes, processing times, service standards or conduct outside IEMC’s reasonable control. This is subject to any express obligation assumed by IEMC in a service-specific agreement, including the RPL refund commitment described above.

Acceptance of Terms

By continuing to communicate with IEMC, submitting documentation, requesting services, making payment, signing an agreement, accepting a quotation or proceeding with a process coordinated by IEMC, the client acknowledges that applicable Terms and Conditions, service-specific agreements, refund terms and third-party terms may apply.

Complaints

Clients with concerns regarding IEMC’s services should first use IEMC’s complaints and dispute resolution process where appropriate. Nothing in this disclaimer prevents any person from exercising a lawful right to make a complaint to a regulator, tribunal, court, consumer protection body or other competent authority.

Privacy

Personal information provided to IEMC may be shared with relevant business partners and service providers, including education providers, RPL Partners, RTOs, migration professionals, insurers, universities, colleges and government authorities, where reasonably necessary to facilitate the requested service and in accordance with IEMC’s Privacy Policy and applicable privacy law.

Refund and Cancellation

Refund, cancellation and withdrawal requests are assessed in accordance with the applicable Costs Agreement or Service Agreement and IEMC’s Refund and Cancellation Policy.

Australian Consumer Law

Nothing in this disclaimer excludes, restricts or modifies any right, guarantee, warranty or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.
